
Chapter 192
STREETS AND SIDEWALKS

ARTICLE I
Snow Removal

~ 192-1. Removal of snow and ice.
Within eight (8)
daylight hours after the conclusion of each snowfall, each property owner or
tenant in the Town of Elsmere shall remove the snow and ice from the sidewalk
and sidewalk area upon his property or the property he tenants.
~ 192-2. Violations and penalties.
Violation of this
Article is not less than ten dollars ($10.) nor more than twenty-five dollars
($25.).
ARTICLE II
Restrictions on Vehicular Access to Public Streets
[Adopted 7-10-1990 as Ord. No. 260]
~ 192-3. Restriction and designation by Council.
The Council of the
Town of Elsmere, by resolution, may restrict or prohibit vehicular access to and
from public streets and establish and designate dead-end streets with
appropriate signage whenever such action: shall not eliminate or deny any
property owner access to and from any public streets as a result thereof; and
shall be in the interest of the public health and safety and welfare.
~ 192-4. Violations and penalties.
Any person who shall
violate a resolution adopted pursuant to this Article, or fail to do any act or
thing required to be done, shall, upon conviction thereof, be subject for each
violation to a forfeit fine not exceeding the sum of one hundred dollars
($100.). In default of the payment of any fine imposed hereunder, such violator
may be imprisoned for a period not exceeding thirty (30) days. Whenever such
person shall have been officially notified by the Town Manager or by service of
a summons in a prosecution, or in any other official manner, that he is
committing a violation, each day's continuance of such violation after such
notification shall constitute separate offense punishable by a like fine or
penalty.
