
Chapter 175
RAILROAD EQUIPMENT

~ 175-1. Blocking of streets.
From and after the
passage of this chapter it shall be unlawful for any Railroad Company to suffer
or permit any locomotive or any train or car or other vehicle belonging to or in
the employ or use of said company to remain stationary or blocking the use of a
public street or road upon the tract or through the use of equipment, gates or
signaling devices, block or impede the flow of traffic across any public street
owned or used by them where the same is crossed by any of the public streets or
roads in the Town of Elsmere, incorporated under the name of the Council of
Elsmere; and if said Railroad Company shall suffer or permit any such
locomotive, train, car or other vehicle so to remain stationary or blocking the
use of a public street or road upon such crossing or by use of equipment, gates
or signaling devices, block or impair the use of public streets or roads for a
longer period of time than five (5) minutes, said company shall forfeit and pay
to the Council of Elsmere a fine of twenty-five dollars ($25.) for the first
offense and one hundred dollars ($100.) for each offense thereafter.
