
Chapter 159
PEDDLING AND SOLICITING

~ 159-1. Registration requirements.
All persons before
entering in or upon a private residence for the purpose of selling or taking
orders for the sale of goods, wares or merchandise, or soliciting contributions
or expressions of opinion, are hereby required to register at the Town Office of
Elsmere and furnish the following information: Full name of registrant and local
address, if any; permanent home address; name and principal office address of
his employer or principal; the type of business or activity in which such
employer or principal is engaged; a description of the goods, wares or
merchandise proposed to be sold or for which orders are to be taken; a
designation of the last previous locality or neighborhood canvassed by the
registrant; a statement as to whether the registrant has been convicted of any
crime involving moral turpitude and, if so, where and the nature of the offense
and the punishment or penalty assessed therefore. Such information shall be
accompanied by a letter or other credentials signed by any authorized managerial
official of the employer or principal, which letter shall affirmatively show the
authority of the registrant to represent such employer or principal.
~ 159-2. Registration card.
Upon furnishing the
information required under ~ 159-1 hereof, the applicant shall be issued a
registration card unless the information furnished in compliance with this
chapter shows that the applicant has been convicted of a crime involving moral
turpitude. The registration card shall be carried by the person to whom it is
issued, and produced for examination upon the request of any householder, peace
officer or official of the Town of Elsmere. The term for which such registration
shall be valid shall be at the discretion of the Council, but in any event shall
not exceed one (1) year.
~ 159-3. Prohibited acts.
Entering a private
residence in the Town of Elsmere by any person under false pretenses, for the
purpose of selling or taking orders for goods, wares, or merchandise or for
soliciting contributions or expressions of opinion; or remaining in a private
residence on on the premises thereof after the owner or occupant thereof shall
request any such person to leave, or going in and upon the premises of a private
residence by any person for any such purposes, when the owner or occupant
thereof has displayed a "No Soliciting" sign on such premises, is
declared to be a nuisance and punishable as such nuisance as a misdemeanor.
~ 159-4. Revocation of registration.
A registration
granted hereunder may be revoked if, subsequent to the issuance of the
registration card, the registrant commits an act which would have prevented his
being registered, or if he violates any provision of this chapter.
~ 159-5. Violations and penalties.
Any person violating
the provisions of ~ 159-1 or ~ 159-3 of this chapter shall upon conviction be
punished by a fine not to exceed one hundred dollars ($100.) or imprisonment for
such a period not to exceed ninety (90) days, or by both such fine and
imprisonment at the discretion of the Court.

There is a charge of
ten dollars ($10.) for permits.
