Chapter 123

 LAWN CARE COMPANIES

~ 123-1. License required.

  All lawn care companies which utilize chemicals in their treatment process shall be licensed by the State of Delaware and follow all state regulations and safety precautions.

~ 123-2. List of chemicals to be provided customers.

  All lawn care companies which utilize chemicals in their treatment process shall provide to their customers, as well as those residents whose property is adjacent to the customer, a list of all chemicals to be discharged on the customer's property. Included with this list should be any general lawn care information pertinent to the treatment process, such as safety and health information.

~ 123-3. List to include trade and generic name.

  The list of chemicals provided to the customer include both the trade name and the generic name of each pesticide to be used.

~ 123-4. Violations and penalties. [Added 6-12-1990 by Ord. No. 257]

  Any person, firm, corporation, partnership or representatives thereof who fails to comply with ~~ 123-1 through 123-3 of this chapter shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than one hundred dollars ($100.) nor more than ($500.), or imprisonment for not more than thirty (30) days, or both.
