 HANDICAPPED PARKING

~ 116-1. Policy established.

 

  The Handicapped Parking Policy for the Town of Elsmere shall be as follows:

 

     A.     All requests for a handicapped parking space shall be submitted in writing to the Elsmere Chief of Police, so that he or she may issue an opinion and make a recommendation to Council.

 

     B.   A copy of the each request shall be distributed to the Public Works Director, so that it may be determined if it is possible to place sign poles at the requested site; and the Public Works Director will meet with the Chief to check the logistics of installation.

 

     C.     Handicapped parking spaces shall be provided only to those possessing either:

 

           (1)  A current Delaware registration plate stating "handicapped" with a number from the Delaware Division of Motor Vehicles; or

 

           (2)  A current Delaware disabled person's parking permit with a number from the Delaware Division of Motor Vehicles, accompanied by the registration plate number in which this permit will be used.

 

     D.   One (1) parking space only shall be provided for each such vehicle.

 

     E.   The parking space designated shall be on the street directly in front of the residence of the applicant and shall only be provided to those who have no driveway on their property.

 

     F.   A sign shall be placed at the parking site stating "HANDICAPPED." This sign shall display the number that has been assigned to the individual through the Delaware Division of Motor Vehicles. A smaller sign shall be placed under the "HANDICAPPED" sign stating "ONLY." The area will be designated a tow-away zone. A yellow curb will be painted to designate the space.

 

     G.   All costs involved in providing the parking space shall be borne by the Town of Elsmere.

 

     H.   A designated handicapped parking area shall terminate and revert back to public parking upon the licensee's death or change of residence.

 

     I.   The fine for unauthorized parking in the area shall be one hundred dollars ($100.) plus court costs plus the cost of towing and storage of the vehicle.

 

     J.   Final determination of eligibility for a handicapped parking space shall be made by the Council of the Town of Elsmere.
